Rationalization of Independent Regulatory Agencies in Kosovo: What are the options?

The process of reforming agencies started in 2016 when in one of the meetings of the Special Group of Public Administration Reform, the representatives of the Republic of Kosovo and the European Union through joint conclusions agreed that the process of reforming institutions and agencies reporting to the Government and the Assembly is very necessary and should start as soon as possible1. Following the conclusions, the Ministry of Public Administration, with the support of SIGMA/OECD, prepared a qualitative and quantitative analysis entitled: ‘Review of independent institutions and agencies of the Assembly and central Government bodies’. Independent Regulatory Agencies (IRAs) were also part of the analysis, therefore this paper will focus on these types of agencies by analyzing the concept and legal basis. The purpose of this paper is to provide an overview of the status, organization and functioning and lines and instruments of accountability of IRAs, but also the options of the Government and the Parliament for their reform for which legal amendments need to be made and which is required to be implemented this year according to the law.
